2024 Integrity Commissioner Report: Multiple Complaints on Guelph Council

The 2024 Annual Report from the Integrity Commissioner for the City of Guelph, prepared by Aird & Berlis LLP, provides an overview of the ethical oversight and accountability of City Council members over the past year. The report covers complaints, investigations, advice given, and the broader implications of upcoming provincial legislation.

Social Media Conduct

Three complaints (2023-02, 2023-03, and 2024-01) were filed against a councillor for alleged intimidation and bullying via social media. While no official violations of the Code of Conduct were found, the Commissioner advised councillors to be cautious when using social media, even on personal accounts.

Council Member Involvement in Protests

A complaint (2024-02) alleged that a councillor engaged in activities that incited violent counter-protests at a non-City event. However, the complaint was dismissed due to falling outside the allowable timeframe for filing.

Overreach of Authority

A councillor was accused (Complaint 2024-03) of speaking on behalf of the entire council regarding a contentious local issue. The Commissioner found no wrongdoing, concluding the member had acted within their authority. Interestingly, the complainant had already received the same clarification from City staff before filing, indicating potential misuse of the complaint process.

Gifts and Benefits Violations

Complaint 2024-04 involved allegations of a councillor improperly accepting gifts, prompting a separate report to Council under the Integrity Commissioner Complaint Protocol.

Mayor’s Self-Disclosure of Gift Violations

The Integrity Commissioner also reported a violation regarding benefits received by the Mayor while serving on an international environmental board. The Mayor had accepted hospitality and paid travel expenses for a Dubai conference. While this was deemed a breach of the Code, no penalty was recommended due to the Mayor’s voluntary disclosure and corrective actions.

Code of Conduct Enforcement Weaknesses

The Commissioner highlighted a unique issue within Guelph’s Code of Conduct: it mandates that any discovered violation – even those disclosed voluntarily – must be reported to Council. This creates potential deterrents for proactive ethical disclosures.

Lack of Timely Complaint Filings

The dismissal of Complaint 2024-02 due to a technical limitation suggests a gap in enforcement mechanisms. The report does not clarify whether this was an issue of awareness or an intentional delay to avoid scrutiny.

Inconsistent Social Media Standards

While no direct violations were found in social media complaints, the Commissioner emphasized the need for clearer guidelines on councillors’ online conduct. Without enforcement measures, the recommendation remains advisory rather than actionable.

Legislative Changes: Bill 241

The introduction of Ontario’s Bill 241 could significantly alter municipal integrity oversight. Key proposed changes include:

  • A standardized provincial Code of Conduct for all municipalities.
  • Mandatory ethics training for council members and Integrity Commissioners.
  • Stronger enforcement mechanisms, including potential removal from office for serious violations that harm public well-being.

The Commissioner has advised against major local Code of Conduct revisions until the final form of Bill 241 is determined.

Missed Opportunities in Training & Education

Despite past commitments, no new ethics training was conducted in 2024 for Guelph’s council. With increasing conflicts and social media concerns, the lack of proactive education represents a gap in ethical governance.

While the Integrity Commissioner’s report identifies areas of improvement, it also highlights systemic weaknesses in enforcement, transparency, and training. The pending provincial reforms under Bill 241 may address some of these concerns, but until then, Guelph’s council remains reliant on a Code of Conduct that lacks strong enforcement mechanisms.
