The City of Hamilton has directed a downtown resident to remove security cameras mounted on the exterior of his home, citing the city’s fortification by-law.
Dan Myles, who lives on MacNab Street North, says he installed the cameras after repeated break-ins at his home and in the surrounding neighbourhood. He argues the devices have been valuable for community safety, noting that police have previously requested his footage for investigations. Myles has also shared videos of break-ins online, and one of his recordings was used by CHCH News in coverage of a fatal crash near Barton and MacNab Streets two years ago.
The City of Hamilton confirmed the order but declined further comment, calling it an active investigation. The fortification by-law prohibits homeowners from monitoring beyond the boundaries of their own property.

Myles questioned the enforcement, pointing out that many residents use doorbell cameras aimed at the street. One of his neighbours, Jane Yates, expressed support for the cameras, saying they help the community feel safer.
Former Ontario Privacy Commissioner Ann Cavoukian offered a different view, stressing that people have a right to privacy in public spaces. She said cameras are acceptable on private property if they include signage, but recording the public without consent raises concerns.
Myles has appealed the city’s order and is awaiting a response.
In Guelph, city staff initiated a review in late 2024 exploring the creation of optional guidelines for residential security camera use—stopping short of proposing a formal bylaw. The review was positioned as part of broader efforts to support community well-being while balancing homeowners’ security interests and privacy considerations
